Digital Axay provides website design and development, and custom web application development. The exact deliverables, features and timelines for each engagement are confirmed in writing before work begins.

Anything not listed in the agreed scope is treated as a new request and may require additional time and cost.

Accurate requirements are essential. The client is responsible for describing the intended purpose, features, pages and functionality of the project as clearly as possible before development starts.

• Providing timely feedback, approvals and clarifications
• Supplying required content, images, logos and brand material
• Providing access to accounts or services needed for delivery
• Ensuring supplied material does not infringe third-party rights

The client confirms that all text, images, logos, videos and other material supplied are owned by them or properly licensed. Digital Axay is not responsible for any claim arising from client-supplied material.

Estimated timelines are provided in good faith and assume timely responses, approvals and content from the client. Delays in feedback, content or third-party dependencies will extend the delivery schedule accordingly.

A reasonable number of revision rounds is included within the agreed scope, and is confirmed per project. Revisions that change the agreed direction, structure or feature set are treated as scope changes.

Written or messaged approval of a stage is treated as confirmation to proceed to the next stage.

Payment terms, including any advance payment and milestone payments, are agreed before work begins. Work may be paused if agreed payments are not received. Final delivery, handover or deployment may be scheduled after settlement of outstanding amounts.

Change requests are welcome and are assessed for impact on time and cost. Significant changes after approval of a stage may require revised timelines and additional charges.

On full payment, the client receives rights to the final delivered website or application as agreed for their business use. Digital Axay retains rights to underlying tools, internal libraries, reusable components and general know-how used to build the project.

Unless the client requests otherwise, Digital Axay may reference the completed project as work in its portfolio.

Projects may rely on third-party platforms, libraries, APIs or plugins. These operate under their own terms, pricing and availability, and their behaviour or changes are outside our control.

Domain registration and hosting are separate from design and development, and are not automatically included in a project. Where required, costs, ownership and renewals are the client's responsibility unless explicitly agreed otherwise in writing.

Ongoing maintenance, updates, content changes and support are not included by default after delivery. These can be arranged as a separate agreement.

Either party may end an engagement in writing. In that case, work completed up to the termination date remains payable, and any applicable refund is handled under the Refund & Cancellation Policy.

Digital Axay is not liable for indirect or consequential losses, including loss of profit, business or data, arising from the use of a delivered website or application. Total liability for any claim is limited to the amount paid for the specific project.

Project communication generally takes place over WhatsApp, phone or email. Decisions confirmed through these channels are considered valid records of agreement.

These terms are governed by the applicable laws of India. If any part of these terms is found unenforceable, the remaining terms continue to apply.
